Care Proceedings

Every local authority has a duty to safeguard and promote the welfare of children and where possible to promote the upbringing of such children by their families. If a local authority has concerns about the safety or welfare of a child, they must investigate the situation in order to decide whether they need to take action to safeguard the child.

If the local authority is involved with your family, our experienced solicitors are here to help you. You should seek immediate legal assistance in order that your position is fairly represented and that you are aware of your rights.

Childcare

A local authority will only initiate care proceedings where they believe that a child is suffering, or is likely to suffer, significant harm due to the way they are being looked after by their parents or carers, or where the child is beyond parental control.

If the local authority do issue proceedings it does not mean that a child will be removed from their parents care if it possible to avoid such action by reaching an agreement with the local authority.  Our firm understand how stressful these situations can be for families we are able to offer parents the support and understanding that they need as well as being able to advise parents how they can improve the situation they are in.

Public Funding
Representation and advice in care proceedings are fully funded by the Legal Services Commission regardless of your financial means. We undertake publicly funded work as we hold a Legal Aid Franchise in Family Law.
