General Litigation

The law of contract is such that you may not even be aware that you are entering into legally binding relations when you are, in fact, doing so.

It is only when a problem arises that the minute details of a specific situation are closely scrutinised to assess what exactly took place and what your position is in this regard. In addition a contract may exist between two parties even if there is no written agreement.

Litigation can therefore arise from a wide range of activities and situations and generally involves a Court process.

General Litigation
Litigation can arise in the following situations:
  • Professional Negligence
  • Company and commercial disputes
  • Debt Recovery
  • Partnership Disputes
  • Contract Claim
  • Contentious Probate Claims
  • Nuisance Claims
  • Injunctions
  • Land and boundary disputes
  • Consumer disputes
  • Landlord and tenant disputes

Any situation where you are in dispute with another party can give rise to litigation. We can advise you on the law in such instances and on whether we consider you have a good case and can act for you.

We can also advise as to whether an alternative to litigation, such as mediation or arbitration would be more suitable in your circumstances.
