Court of Protection

If someone you care about loses the mental ability to deal with their own finances and affairs, and they have not put a Lasting Power of Attorney in place, Bana Vaid & Associates Limited can advise you about the best courses of action to help them.

In such circumstances it will be necessary for someone (usually the next of kin) to apply to the Court of Protection for authority to manage their financial affairs. A person authorised by the Court to act is called a "Deputy".

We can advise you as to what information the Court will require if you make an application to act as a Deputy for someone who is mentally incapable. We will also ensure that the correct documents are completed when making such an application.

This will include ensuring that you understand the importance of The Mental Capacity Act 2005 and its code of practice and also that acting as a Deputy means that there is an inherent duty to maximise your client's income.
